Abstract

This study examines the legal framework governing the protection of public funds, considering them the essential material foundation for the operation of public utilities and the realization of public interests. The research addresses the legal nature of these funds and the various guarantees established to safeguard them against misuse or encroachment. Using an analytical and comparative approach, focusing on Libyan legislation alongside other legal systems, the study evaluates the effectiveness of current administrative and civil safeguards. The findings highlight the necessity of a robust legal regime that balances the state's authority over its property with the public’s right to benefit from these resources. The study concludes with recommendations to strengthen legislative protections and enhance oversight mechanisms to ensure the sustainability of public assets.
